Not All Surgeries End In Death, Some End With Constant Pain

When we enter hospitals we have this assumption that the doctor and their staff know best, and we should. Doctors have to go through such rigorous training that they do know more than most. Doctors carry the responsibility and burden of taking the best course of action for a patient. Sometimes, though, the best course of action does not always work out. At the end of the day, Doctors are just normal people. We all make mistakes. The difference is that when Doctors make mistakes it can lead to fatal situations. This includes the hospital’s staff such as nurses and healthcare workers.

Here are some examples of defective products.

  • In 2006, Jim Shull was prepped for hernia surgery. This is a very normal and frequently conducted surgery. He was told that this surgery had a quick recovery time and was promised to be up and about in as little as two weeks. Shull was very happy to hear this and proceeded with the surgery. After surgery, Shull felt severe pain in the hernia area. His original surgeon was unable to explain the reason for the pain, so Shull went to another doctor. After two years of extraordinary pain, he learned that the mesh used to fix a hernia was defective. It had hardened inside him and was acting as a “saw and cutting into the surrounding tissue”. He is now on permanent disability and unable to work.
  • In 2008, Jaye Nevarez had a hysterectomy in which her doctor used a transvaginal mesh to address other medical issues involving the urinary tract system. Since her operation, Nevarez experienced infections and constant pain from the defective mesh inside of her. The doctors removed the mesh immediately once the correlation was found, but she still continues to feel pain.
  • In 2010, Diane Henifin had knee replacement surgery. She hoped that the surgery would improve her overall life. She understood that surgery would be needed in both knees, but her first knee replacement did not go as planned and she is worried about her future. After her first knee replacement, she went for a whole year in pain. Her doctor blamed the pain on her being overly sensitive until tests were conducted to show that she had a defective device on her knee.

These examples show various cases where a patient experiences a defective device. The doctors knew what they were doing, but they were using technological devices that were not suited to the human body.
